Legal and Human Rights NOT Respected in Ontario

This is a copy of an e-mail I have sent to the Ontario Ombudsman’s Office and some politicians.

SUBJECT: Canadian’s Legal and Human Rights Casually Ignored in Ontario with NO Oversight, and Wasting Scarce Healthcare Funds

Dear Ombudsman,

I don’t know if your position of overseeing of the Ontario government’s actions could include this problem, but considering there is far too much casual and abusive stripping of Canadians of their legal and human rights going on in Ontario I thought I’d speak up. Or maybe just the theft and waste of scarce taxpayer health money may be of interest to your office.

Recently Ontario has been complaining about the Federal Government not doing enough to protect the rights of an Ontarian citizen who was outside of the country but right here in Ontario citizens are being picked up simply for political reasons, or to fill beds to increase hospital income, and no one seems to care. More scarce health dollars are wasted instead of going where they are needed, and the poor and vulnerable are being denied their legal and human rights by abusive people simply for local financial and or political gain.

Part of my working background includes 12 years of providing security to Canada and Canadians, including my working on such prestigious sites like Canada Post Headquarters, Department of National Defense locations, and even at the Privy Council of Canada. I do not have a criminal record, but I am physically damaged so currently have to live on Ontario disability and am therefore poor and an easy target. People at the Royal Victoria Hospital here in Barrie have had me picked up by the police on a few occasions for political reasons simply because I am currently poor and not associating with anyone who would notice my disappearance or who could afford to do anything about it anyway. They have ignored the fact that there are specific requirements to engage in that type of action against a person because there is no oversight of their actions or repercussions for them to be concerned with their breaking the law. It is so bad at the RVH that even non doctors chose to illegally detain me after I was supposedly released and given my legal freedoms back by the psychiatrist who was threatening me the last time, and I dared not challenge them by simply informing them of the law because hospital personnel had already proven my legal rights to be meaningless and that they will do what they please to protect the hospital from any upset. Of course after the last event I no longer feel I can safely return to that hospital (which is the only one in Barrie) and I will choose not to do so even if I think I may be suffering from a heart attack or stroke, or if I am injured in an accident or collapse from heat exhaustion, or for any other reason. Instead of protecting me from harm, as was their claimed pretenses for having me picked up, they have caused a major threat to my life by their repeated illegal and abusive actions against me because I now cannot trust them to act in my best interests or to show any concern for my physical pain either, as they have also proven by other previous actions, so I am only interested in avoiding them as long as I have the free choice to do so.

In 2005 I was locked up twice within weeks under the pretense of evaluation purposes simple to hide me from public view, the second time for the Barrie Kempenfest holiday weekend event when the RVH sent the police to pick me up off the street, and both times simply because I was on the same hunger strike in front of one of Barrie’s prominent businessmen’s businesses. And just recently I was dragged from my home to be threatened to be made to disappear within the psychiatric system without my ever being allowed to even plead my case before a judge if I didn’t stop the action I was involved in that might bring bad publicity against the hospital. They simply need to eventually fill out a form with a doctor’s signature and the police can apprehend you anywhere to transport you to the hospital for them to do as they please, and no one has to account for anything. The police coming to your home to arrest you on the casual pretense of concern for your well being as claimed by someone does not inspire trust in our police either, which is a further threat to our society when people on the edge of society are being abused with the help of the police so learn not to trust or respect police, doctors, or anyone else in authority for that matter. This kind of abuse is not helping anyone, and instead actually causes an increased threat to people’s mental and physical health when they learn they cannot trust doctors, hospitals, or the police to be anything other than just more abusive people who’ll hurt them instead of help them.

A Mental Health Act law that promotes mental abuse makes no sense, unless the government actually wants to promote the mental abuse of people instead of helping those who might be suffering from mental stresses or from other mental disabilities. For what reason was the law created, to help people who may have a mental problem or to make it easy for those in certain positions to casually engage in the abuse of others? Maybe the law was created simply for political purposes to make it easy to casually drag off those who are poor or without influence to cater to businesses and the wealthy and influential? Even judges cannot have anyone they please simply picked up and locked away (and repeatedly at that) without any public scrutiny but that is exactly what some hospital staffers are doing on a regular and casual basis to people. Are Ontario politicians proving by the laws they make that they are just like all other abusive dictatorship rulers who have no concern for the legal or human rights of their citizens, by creating or ignoring a law that removes anyone’s rights without any proper oversight or controls to reduce the opportunities for the vile or casually callous to abuse their citizens?

There are methods that could be used to reduce the opportunities for abuses to occur if any of our lawmakers would care to take the time to think about it and to do some work to protect our citizens. Some examples they could consider are:
If a hospital detains a person more than once then there should be an automatic legal requirement so the person has a chance to present themselves before a judge to reduce opportunities for someone to be repeatedly abused by a doctor and or hospital. Not a once only opportunity to prove your position to only one judge of course, as any legal process has appeal rights to gave further protection of the law to people from biased or corrupt judges and or errors of understanding or errors of law.
Police could be required to first check a person’s identification and then check with hospitals before apprehending someone to be hauled off for psychiatric evaluation, to reduce their misusing the power simply because they disagree with someone’s actions that are based on their political, religious, or basic philosophical beliefs, or because they are under political instructions to help bring more money into a community hospital (let setting up speed traps) or to hide certain people during city events.
And the number of times hospitals detain people against their will should also be monitored on a regular basis (and especially checked out for dates and increases) to reduce chances of psychiatrists simply picking up poor people to fill beds to increase hospital or their departmental income, or to hide the poor from tourists during city events.
It only took me a few minutes to think of these few improvement examples so a longer attention to the issues could uncover other concerns that should also be addressed if the politicians ever bother to concern themselves with correcting this threat against Canadian’s rights. Rights are meaningless if they are allowed to be so casually ignored by so many without at least trying to include some proper oversight protections.

No one should need to have to be rich enough to be able to sue, or even need to have to sue, a hospital to appear in court to fight against being illegally kidnapped, threatened, and detained by abusive people who have no fear of reprisal for their illegal actions.

I’ll try the Canadian Government Ombudsman office also, because the federal government is involved in funding of hospitals so they may find that venue of interest if they care about Canadian’s being protected in Canada against having their so-called Citizenship and human rights casually abused and stripped from them or about taxpayer health money being used for illegal purposes. I think I’ll send a copy to some politicians also in case one of them might care enough to attempt to address the problem in some way and maybe to some organization that claims to care about poor people or basic human rights. I will also post this on some online sites so others may have a chance to come across the information and my attempts to stop this abuse.
